TERMS AND CONDITIONS

THE CONDITIONS ARE AN INTEGRATED PART OF THE PRESENT RENTAL AGREEMENT:

Terms and Conditions

• Rental is only available to people over the age of 16. For tenants under the age of 18, a legal guardian must also sign the present rental agreement.

• The place of jurisdiction is the local and factual court responsible for Mühlbach am Hochkönig. Austrian law applies as agreed.

Returning the rental equipment

• In the beginning, the renter receives instruction on the proper handling of the e-bike, after which the e-bike will only be handed over when no more questions are left unanswered. At this point, the renter also confirms that they have received the bike in perfect condition.

• The bike may not be passed on to third parties.

• By concluding the rental contract for the e-bike, the renter agrees to the professional adjustment of the saddle height, brakes, and bike geometry, in accordance with their personal information.

Use and care during the rental period

• The lessee undertakes to treat the bicycle with care and to return it in proper condition by the end of the agreed rental period.

• Any extension of the rental period must be expressly agreed with the landlord.

• The rent is due in advance upon collection.

Transfer to third parties

• The transfer or subletting of the rental item to third parties is prohibited.

• Route and tour selection

• The renter follows the suggested bike tour at his own risk and agrees not to hold Bike Mühlbach responsible for any injuries or accidents. We strongly recommend the use of a bicycle helmet, which we also offer for hire.

• The selection of the terrain and the routes in which the rental item and accessories are used is made exclusively at the lessee's own initiative, responsibility, and risk. When used on trails, the general rules of conduct apply. The lessee undertakes to comply with the provisions of the StVO and may only use the bicycle on public property and on private property with the express consent of the person entitled to dispose of it.

Liability

• The bicycles provided for use are in a satisfactory operating condition and the renter undertakes to use them at his own risk or to bring any defects to the attention of a Bike Mühlbach employee. ​Individual bike specifications are subject to change based on the availability of replacement components.

• Bike Mühlbach is not liable for any injury, death, personal injury or property damage, loss or delay in means of transport (in this case e- and mountain bikes) or due to events beyond Bike Mühlbach's actual control or due to force majeure.

• The renter is fully responsible for the rented e-bike (or children's mountain bike).

Damage

• The renter is liable for damage to the bicycle, for the loss of individual parts or the entire bicycle, as well as for the costs that arise in this connection.

• In the event of damage caused by improper handling and excessive use of the rental object, the lessee is liable for the resulting costs.

• Bike Mühlbach is not liable for damage to the bicycle, for damage to persons and property, for damage to third parties, and for consequential damage caused by or with the rental item. The renter is liable for any damage to the bicycle and accessories, except wear and tear material.

• In the event of damage to the rented item including rented accessories caused by the renter, as well as loss or theft, the damage must be paid in full by the renter (unless bike insurance has also been taken out with Bike Mühlbach) and authorized Bike Mühlbach to debit a reasonable amount to cover the damage before the damage is finally determined.

Return and condition of the rental object

• All rented items are to be returned to Bike Mühlbach cleaned, complete, and in proper condition at the end of the rental period. If the agreed rental period is exceeded, the additional rental period will be charged. The rented bike and any additional rental items must be returned no later than 5:00 p.m. on the last rental day. In the event of early return, the proportionate rent will not be reimbursed.

Insurance

• It is pointed out that the rental item and its accessories are not insured. The lessee is expressly advised to take out sports insurance unless he has sufficient liability insurance to ensure that any damage is covered.

Cancellation

• The cancellation cost protection can be taken out online immediately when booking the equipment. This is 10% of the list price. Bookings with cancellation protection can be picked up up to 2 days before
